Šulija & Partners Law Firm Vilnius has successfully defended the interests of an Egyptian defence-sector company, in a dispute with a Lithuanian partner concerning the enforcement of a Consortium Agreement relating to the supply of Polish-manufactured machine guns to the Egyptian Armament Authorities.
Although an Egyptian company had fully complied with its financial and contractual obligations, the Lithuanian company attempted to appropriate the contractual benefits for itself. This conduct raised serious concerns over our client's recovery prospects, especially given the Lithuanian partner’s precarious financial position.
Recognising clear indicators of fraud on the part of the Lithuanian management, our team advised initiating a criminal pre-trial investigation in Lithuania. Despite initial refusals by the authorities to proceed on the basis that the dispute was “civil in nature”, we pursued a determined litigation strategy. Through five separate appeals, we successfully overturned each refusal in court, obliging the authorities to open criminal proceedings.
This case illustrates our firm’s ability to act decisively and effectively in cross-border disputes involving complex contractual enforcement and fraud risks, ensuring that our clients’ rights are fully protected even in challenging jurisdictions.
