Debt Recovery Proceedings

12 Jan 2016

The District Court of Varena Region upheld the claim of our Professional association of advocates representing the creditor’s interests in a civil case and ruled that the claimant shall recover from the defendant the full amount of the 30 000 litas debt (an advance payment received by debtor under a contract), as well as penalty in the same amount (30 000 litas). The client’s interest were thus fully defended in court.

The arguments of our lawyers convinced the court that the principle of freedom of contract should be respected in this case and that taking into account the circumstances of the case the amount of penalty is justified and there are no legal grounds for the court to reduce such amount.
