Dr Gintautas Šulija, the Managing Partner of the Law Firm, commented on the dismissal of the Deputy of Head of State Tax Inspectorate Vilma Vildziunaite.
The Head of the State Tax Inspectorate Modestas Kasiliauskas, has dismissed his Deputy Vima Vildziunaite on the last day of his tenure. The Head of the State Tax Inspectorate has stated that a gross misconduct in office took place and that the strictest disciplinary sanction – dismissal from the office – should be applied in respect of Ms Vilma Vildziunaite.
“The essence of the dismissal – a deemed misconduct, related with the company’s unpaid default interest in the amount of 78 cents. At the same time, the company had overpaid the State Tax Inspectorate 166 LTL of taxes. In assessing whether a company is indebted, these sums may be subtracted from each other in accordance with the procedures prescribed by law, - stated Dr Gintautas Šulija – The dismissal is also based on a minor procedural drawback – the received document was not registered the same day. This may not in any way be interpreted as a gross misconduct of a public servant”.
Dr Gintautas Šulija also noted that the order of the Head of the State Tax Inspectorate was passed hastily, without giving a person the right to be acquainted with the results of the investigation and depriving of the possibility to provide additional explanations. This order will most likely be challenged in the court.
