Anticipated legislation

On 13 July 2011 the Government of the Republic of Lithuania has approved the Concept of the Class Action. The concept of the class action has been prepared in light of the Governmental programme as approved by the Parliament of the Republic of Lithuania on 9 December 2008, whereby “the balance between the effective control of consumer’s rights and the protection of legitimate interests of service providers had to be safeguarded”. Currently, the Code of the Civil Procedure does not provide for the special rules on the class action proceedings. According to the concept, it is anticipated that the special new chapter “Hearing of the class action claims” would be added in the Code of the Civil Procedure. The Ministry of Justice was assigned to prepare the new law drafts and submit them to the Government of the Republic of Lithuania until 1 January 2012.
